Unanimously the Special Court of the Superior Court of Justice decided this Thursday to dismember the complaint presented by the Federal Public Ministry about an alleged criminal scheme installed in the Executive Branch of Acre maintaining in the STJ only the accusation against the state governor Gladson Cameli. As a consequence the complaint against those investigated who do not have jurisdiction due to their role will be distributed to the competent criminal courts.

The rapporteur of the case Minister Nancy Andrighi highlighted the STJ's jurisprudence in the sense that except in exceptional cases the rule must be the dismemberment of criminal actions in relation to defendants who do not hold positions that attract the forum by function prerogative.
According to the minister the size of the process the complexity of the facts and the number of defendants in the same action could harm procedural speed. The rapporteur also stated that the dismemberment does not prevent the investigation of all crimes including criminal organizations.
“Although the accusations of active and passive corruption practices as well as criminal organization are against the defendants these elements in themselves do not require a joint trial of the accused should not determine the exceptional extension of the forum and consequently should not prevent the dismemberment of the process since criminal responsibility is subjective and therefore to lead to a possible conviction the burden of the prosecution of individually proving the charges in relation to each accused must be fulfilled” concluded the minister.
